The services of surrogate mothers in Russia can be used not only by the officially registered couples. Article 35 of legislation basics of RF about health care of the citizens unambiguously consolidates the right of a woman not officially being married to make recourse of any of reproductive technologies. It is worth noting that in the latter case it is advisory from the very beginning to apply to the lawyers’ services as the process of the registration of the child (children) will be more complicated in comparison with the one for a married couple. Single men are completely deprived of the excess to the assisted reproductive technologies.
By the way, there are cases when a surrogate mother can refuse to give the child to his “parents” but at the same time also the “parents” can refuse to take the child. Such issues happen when a baby is born ill or a surrogate mother gives birth to twins or triplets. It is necessary to pay attention to an agreement scope, legislative duties of the parties, responsibility, confidentiality of the information and fine sanctions for surrogate mothers because of breaching the conditions of the contract. There surely exist cases when surrogate mothers blackmail parents and threaten with abortion, demanding to increase the compensation or to obtain additional services.
